Appointment of the Governor
The Constitution, in Article 153, specifies the appointment of a Governor for each state. Following the Seventh Constitutional Amendment, it became permissible for an individual to hold the position of Governor for multiple states concurrently, as evident in the current practice of some Governors. The appointment of Governors is carried out by the President of India for a tenure of 5 years.
Qualification of Governor
- That person should be a citizen of India.
- To become a Governor the minimum age should be 35 years.
- The Governor should not be holding any office of profit at the time of being elected to the post.
- To be selected for the post of Governor, he must fulfill all the qualifications for a member of the State Legislative Assembly.
Governor Salary in India
Governors in all states receive a monthly salary of Rs 3.5 lakh, while the Prime Minister earns Rs 1 lakh per month. The President’s salary is Rs 5 lakh, and the Vice President’s is Rs 4 lakh. Additionally, governors receive various allowances that vary by state, including leave allowance and government accommodation maintenance. They are entitled to free medical care at government hospitals, complimentary vehicle hire for official duties, and travel allowances for vacations, among other benefits.
Powers of Governor in India
The Chief Minister is appointed by the Governor, who also appoints the Advocate General, Chairman, and members of the Public Service Commission. The Council of Ministers is established based on the Chief Minister’s advice and functions solely upon the Council’s guidance. The Governor serves as the Chancellor of all state universities. Without the Governor’s approval, the Finance Bill cannot be introduced in the Assembly, and no bill can be enacted without the Governor’s consent. The Governor has the authority to halt, return, or refer a bill to the President. However, if a bill is sent back by the Governor and subsequently passed by the Assembly unchanged, the Governor must then give approval.
Can a Governor Be Arrested or Detained?
Section 135 of the Code of Civil Procedure provides immunity from arrest to certain officials such as the Prime Minister, Union Ministers, members of Parliament and state legislatures in civil cases only. Approval from the Speaker or Chairman of the House is required for their arrest, and they cannot be detained before, during, or after sessions. Additionally, they cannot be arrested within the premises of the Parliament, Assembly, or Legislative Council.
Article 361 of the Constitution provides immunity to the President and Governors from arrest or detention while in office. They are also protected from court orders and enjoy immunity in civil and criminal cases. However, this immunity ceases once they leave office. Governors are crucial for facilitating communication and relations between the central and state governments, particularly when the two have differing political parties.
